According to the first paragraph of section 3.13 of the Act respecting the Ministère du Conseil exécutif, the Government may exempt from the application of Division II of this Act, in whole or in part, an agreement or class of agreements, to the extent and under such conditions as it determines.
Order in Council 1163-2023, dated July 12 2023, allows for the exclusion, from the application of sections 3.11, 3.12 and 3.12.1 of this Act, of agreements that involve the provision of financial assistance under the Economic Development Agency of Canada for the Regions of Quebec's Regional Economic Growth through Innovation Program, Quebec Economic Development Program or Community Futures Program.
In accordance with the fourth paragraph of this Order in Council's operative provisions, the Minister Responsible for Canadian Relations and the Canadian Francophonie shall publish, on the website of the Secrétariat du Québec aux relations canadiennes, an updated list of the initiatives under these programs to which Order in Council 1163-2023, dated July 12 2023, does not apply.
Reminder: To be considered eligible for the purposes of the Order in Council issued on July 12 2023, the agreements to which the Order in Council applies must meet the conditions listed therein.
Organizations covered by the Act respecting the Ministère du Conseil exécutif that wish to enter into an agreement with the Economic Development Agency of Canada for the Regions of Quebec as part of the initiatives listed above must, depending on the case, obtain prior authorization from the Government or the Minister Responsible for Canadian Relations and the Canadian Francophonie.
Please note that existing agreements about the aforementioned initiatives entered into in accordance with the terms of the Act respecting the Ministère du Conseil exécutif shall continue to be valid.
